INSTANT WIN GAME/SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. GAME/SWEEPSTAKES BEGINS AT 12:00:01 AM (ET) ON 4/15/08 AND ENDS AT 11:59:59 PM (ET) ON 8/7/08.
1. UPC CODES: A Universal Product Code from a package of a STARBURST® Brand or SKITTLES® Brand product (a "UPC Code") is required to play and enter. UPC Codes are available on the outside of all packages of STARBURST® Brand and SKITTLES® Brand products (the "Participating Products"). Game/Sweepstakes ends at 11:59:59 PM (ET) on 8/7/08.
2. TO PLAY INSTANT WIN GAME AND ENTER SWEEPSTAKES: Complete official registration form available at www.starburst.com or www.skittles.com, enter your UPC Code, then follow the on-screen instructions to proceed. PLAYS MUST BE COMPLETED BY 11:59:59 PM (ET) ON 8/7/08. Each play will be deemed to have been submitted by the record holder of the email address from which the play originated. Limit: three (3) plays per email address per person per day. You can not use the same UPC Code for more than one (1) play per day. If more than three (3) plays per email address per day are received, the excess plays will be disqualified. Instant Win Game: If you are the first player to pick a city location on or after the predetermined time and date for the most recent prize message made available, you will receive a game message that says "You've Won!", and you will win the prize indicated, subject to verification of eligibility. Winning dates and times will be randomly predetermined under the supervision of D.L. Blair, Inc., an independent judging organization whose decisions are final on all matters relating to this Game/Sweepstakes. Sweepstakes: Each time you play the Instant Win Game with a UPC Code from a Participating Product other than STARBURST® GUMMIBURSTS™ Candies or SKITTLES® Chocolate Mix Bite Size Candies, you will automatically be entered once into the Sweepstakes described in Paragraph 6 below. Each time you play the Instant Win Game with a UPC Code from a STARBURST® GUMMIBURSTS™ Candies or SKITTLES® Chocolate Mix Bite Size Candies, you will automatically be entered twice into the Sweepstakes described in Paragraph 6 below.
3. PRIZES AND ODDS: Five (5) Sweepstakes Grand Prizes: A trip for four (4) to a Maroon 5 concert in the U.S. selected by Sponsor (the "Concert") consisting of a four (4) day/three (3) night trip to the Concert location, including round-trip coach class air transportation from major airport nearest winner's home (as determined by Sponsor) or round-trip limousine transportation from winner's home if winner resides within 150 miles of the Concert location (as determined by Sponsor), double occupancy hotel accommodations, four (4) VIP tickets to the Concert (seating to be selected by Sponsor), an after party attended by Maroon 5 and other guests (the "After Party"), and transfers to/from the airport and hotel and to/from the hotel, Concert and After Party. All other expenses not described in the prize description above (including, but not limited to, additional ground transportation, meals, food and beverages and gratuities) and taxes and fees, if any, are the sole responsibility of the prize winner. Winner and trip participants must travel together on the same itinerary on dates specified by Sponsor (which are subject to change) or prize may be forfeited and awarded to an alternate winner. If, for any reason, the Concert and/or the After Party are postponed or cancelled, Sponsor is not responsible, and trip will be awarded without Concert tickets and/or without the After Party, as the case may be, on same itinerary. Minors must be accompanied by a parent or legal guardian. Additional restrictions apply. Actual value of prize trip will depend on Concert location and winner's point of departure. Approximate Retail Value ("ARV"): $15,000 each. Ten (10) Instant Win Game First Prizes: one of the following, randomly selected by Sponsor: (a) one drumhead and set of drumsticks autographed by Maroon 5. ARV: $140; (b) a Taylor® Acoustic Guitar autographed by Maroon 5. ARV: $899; (c) a pair of Adam Levine's Ray Ban® Wayfarer sunglasses and an 8" x 10" glossy print of Maroon 5 autographed by Maroon 5. ARV: $190; (d) handwritten lyrics to a Maroon 5 song autographed by Maroon 5. ARV: $150; (e) Maroon 5's personalized Platinum Record Plaque of "It Won't Be Soon Before Long" and an 8" x 10" glossy print of Maroon 5 autographed by Maroon 5. ARV: $150; (f) an "It Won't Be Soon Before Long" Songbook autographed by Maroon 5. ARV: $75; (g) a Maroon 5 2008 Tour Program and a copy of the book "Maroon 5: Midnight Miles," each autographed by Maroon 5. ARV: $135; (h) all 3 of Maroon 5's compact disks and their "Live Friday The Thirteenth" DVD, each autographed by Maroon 5. ARV: $85; (i) the September 6, 2007 issue of Rolling Stone® Magazine featuring Maroon 5 autographed by Maroon 5. ARV: $150; and (j) Adam Levine's Yves St. Laurent vest and an 8" x 10" glossy print of Maroon 5 autographed by Maroon 5. ARV: $540. Fifteen (15) Instant Win Game Second Prizes: A Garmin GPS nuvi® 750 street navigator. ARV: $589 each. Two Hundred (200) Instant Win Game Third Prizes: An autographed copy of the Maroon 5 compact disk "It Won't Be Soon Before Long." ARV: $25 each. Ten Thousand (10,000) Instant Win Game Fourth Prizes: One (1) song download provided by Music Cash™. Song downloads expire 12/19/08. ARV: $0.99 each. One Hundred Thousand (100,000) Instant Win Game Fifth Prizes: Maroon 5 electronic wallpaper/screensaver. ARV: $0.50 each. Total ARV of all prizes: $151,249. Odds of winning an Instant Win Game prize depend upon the date and time of each play. Odds of winning a Sweepstakes Grand Prize depend upon the number of eligible entries received. Limit one (1) Sweepstakes Grand Prize and one (1) Instant Win Game First or Second Prize per family or household. Sponsor reserves right to substitute prizes of equal or greater value. No other substitution or transfer of prizes permitted. Sponsor responsible only for delivery of prize; not responsible for prize utility, quality or otherwise. Taxes and fees, if any, are the sole responsibility of prize winners.
4. INSTANT WIN PRIZE CLAIMS: Each potential winner will be notified using the information provided on his or her official registration form. Unclaimed/unawarded Instant Win Game First and Second Prizes will be awarded in a Second Chance Drawing described below (assuming sufficient number of eligible entries). Other unclaimed/unawarded prizes will not be awarded. No more than the stated number of prizes will be awarded. In the unlikely event that winning messages for any Instant Win Game prize level are distributed in numbers greater than the number stated in these rules for such prize level, that stated number of winners will be selected in a random drawing from among all verified prize claims received for that prize level.
5. SECOND CHANCE DRAWING: Any Instant Win Game First and Second Prizes that are not claimed/awarded will be awarded in a Second Chance Drawing, assuming a sufficient number of eligible entries. Each time you play the Instant Win Game, you will be automatically entered in the Second Chance Drawing. Winners will be determined from all eligible entries received in a random drawing to be conducted on or about 9/8/08 by D.L. Blair, Inc. Odds of winning depend upon the number of eligible entries received and the number of unclaimed/unawarded Instant Win Game First and Second Prizes available. Winners will be notified by mail.
6. SELECTION OF SWEEPSTAKES GRAND PRIZE WINNER: Potential Sweepstakes Grand Prize Winners will be determined from all eligible entries received in a random drawing to be conducted on or about 8/8/08 by D.L. Blair, Inc. Sweepstakes Grand Prize Winners will be notified by overnight delivery.
7. ELIGIBILITY: Game/Sweepstakes open to individual legal residents of the 50 United States and the District of Columbia, age 13 or older as of 4/15/08 except employees (and their immediate families and members of the same household) of Sponsor, its affiliates, agents, judges and advertising and promotion agencies.
8. VERIFICATION OF WINNERS AND DELIVERY OF PRIZES: Prize claims subject to verification by D. L. Blair, Inc. Sweepstakes Grand Prize Winners and Instant Win Game First and Second Prize Winners will, and other Instant Win Game prize winners may, be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. Entry into this Game/Sweepstakes constitutes prize winners' agreement to sign such releases. Each Grand Prize trip guest (or parent/legal guardian if such guest is a minor) must sign a travel release. Grand Prize affidavits/releases must be returned within five (5) days after mailing to winner; Instant Win Game Prize affidavits/releases must be returned within fourteen (14) days after mailing to winner. Prize may be awarded to alternate winner if affidavit and releases are not returned within the time specified or if prize notification letter or prize is returned as undeliverable. If Sweepstakes Grand Prize or Instant Win Game prize is won by a minor, it may be awarded in the name of a parent or legal guardian in Sponsor's sole discretion. Allow 6-8 weeks for prize delivery. Prize winners agree to use of name, address, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, any such use with respect to minors to be subject to prior approval of parent or legal guardian. Prize claims and entries are sole property of Sponsor and will not be returned.
9. GENERAL: This Game/Sweepstakes is void outside the United States and where prohibited or restricted by law and subject to all applicable federal, state and local laws and regulations. This Game/Sweepstakes will be governed by the internal laws of the State of Delaware. Any and all legal actions or claims arising in connection with this Game/Sweepstakes must be brought in a court of competent jurisdiction within the United States of America. Sponsor and judges not responsible for late, lost, stolen, damaged, garbled, incomplete, misaddressed, postage due, or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Further, Sponsor and judges not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in entrant's email account to receive email messages. The use of automated software or computer programs to register for or to play the Instant Win Game or enter the Sweepstakes is prohibited and any individual who uses or attempts to use such methods to register or play will be disqualified. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with, this Game/Sweepstakes, and reserves the right, at its sole discretion, to modify, cancel, terminate or suspend this Game/Sweepstakes should any virus, bug, technical failures, unauthorized human intervention or other causes beyond Sponsor's control corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game/Sweepstakes. In the event of any such cancellation, termination or suspension, a notice will be posted and a random drawing to award the Sweepstakes Grand Prizes and all remaining Instant Win Game prizes will be held from among all eligible, non-suspect entries received prior to such time, providing a sufficient number of such entries were received. Sponsor reserves the right, at its sole discretion, to disqualify any entrant (and all of his or her entries) from this Game/Sweepstakes or any other promotion conducted now or in the future by Sponsor or any of its affiliates if he or she tampers with the entry process or if his or her fraud or misconduct affects the integrity of the Game/Sweepstakes. Sponsor reserves the right to correct clerical or typographical errors in promotional materials. By participating in this Game/Sweepstakes, each entrant accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges and warrants that s/he is eligible to participate in this Game/Sweepstakes. By accepting prize, winner agrees to release Sponsor, its directors, employees, officers, and agents, including without limitation, its advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prize or participation in any prize-related activities.
10. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GAME/SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
11. WINNERS LIST: A list of Grand, First and Second prize winners will be available at www.starburst.com and www.skittles.com after determination/selection and verification of winners.
